NO!A crucial element of a contract is lawfulness – and contravening any provincial or federal legislation is NOT lawful. Specifically here in Ontario, the Retail Business Holidays Act takes precedence over any clause in a lease. A Landlord may ask a Tenant to remain open 365 days a year and might even write it in the Lease, but they will have an extremely difficult time relying on that clause to issue a Default Notice to a Tenant not opening on Christmas Day for example.
We have so many laws across our great country, and it is important to understand what protections are already in place. We can help you understand them so you are prepared for your Tenancy!
