A crucial element of a contract is lawfulness – and contravening any provincial or federal legislation is NOT lawful. Specifically here in Ontario,  the Retail Business Holidays Act takes precedence over any clause in a lease. A Landlord may ask a Tenant to remain open 365 days a year and might even write it in the Lease, but they will have an extremely difficult time relying on that clause to issue a Default Notice to a Tenant not opening on Christmas Day for example.
